Of the 200+ FDA warning letters sent to healthcare practices in 2024, regenerative medicine clinics - stem cell, exosome, PRP, BMAC, Wharton’s jelly, peptide therapy - were the single highest-density target. After reading a large sample of those letters and the parallel FTC settlements, five phrases show up in almost every case file. These are the five to remove first.

Phrases that account for most stem cell enforcement
Not an exhaustive list. A defensible program still needs a full pre-publish scan. But if you only have time to fix five things this week, these are the five.
Why regenerative medicine draws disproportionate enforcement
Three structural factors converge to make stem cell and related treatments the densest target for FDA and FTC action:
- The HCT/P framework is tight.Under 21 CFR Part 1271, most clinical uses of autologous or allogeneic cell products require drug approval unless they meet narrow “361 HCT/P” criteria. Most clinic-level uses don’t. The procedure is an unapproved biological drug the moment it’s marketed for a disease indication.
- Desperate patients with chronic conditions. Clinics market to patients who have been through conventional medicine and are searching for an out. Regulators treat the vulnerability of that audience as an aggravating factor in enforcement.
- High-dollar cash-pay procedures.$5,000–$25,000 treatments with minimal clinical substantiation. The FTC’s deceptive-claim theory hits hardest when the financial exposure for the deceived consumer is large.
You can still run a compliant regen-med marketing program. It requires leaning hard into patient-experience language and away from disease- claim language. The five phrases below are the highest-ROI fixes.
Phrase 1: “FDA-approved stem cells”
Most-cited single phrase in 2024–2025 stem cell warning letters. Most clinics using this language mean one of three things:
- Their facility is FDA-registered as a tissue establishment (not approval).
- The cell product comes from an FDA-registered lab (not approval).
- They’re genuinely confused about the regulatory status.
In every case, the phrase is regulatorily false. The FDA has not approved cellular products for most clinical indications being marketed.
“FDA-approved stem cell therapy for knee arthritis.”
“This procedure is performed in an FDA-registered tissue establishment under 21 CFR Part 1271. It is not an FDA-approved drug or device. Knee pain should be diagnosed and discussed with a qualified physician.”
Why: Disclose the registration explicitly and separate it from approval. Route the clinical condition (knee pain) to diagnostic care rather than marketing a specific outcome.
Phrase 2: “Heals/cures [named condition]”
Textbook drug claim. “Heals arthritis,” “cures fibromyalgia,” “heals damaged cartilage,” “cures chronic pain.” Each one converts an unapproved procedure into an unapproved drug representation. See the structure/function vs. disease claims post for the full regulatory theory.
“Our stem cell protocol heals damaged cartilage and cures arthritis.”
“Some patients report reduced joint discomfort and improved range of motion after treatment. Individual results vary and are not guaranteed.”
Why: “Heals” + “cures” + named conditions = unapproved drug claim. Compliant version reports patient experience without clinical outcome assertion.
Phrase 3: “Reverses aging”
Dual violation. From the FDA angle, “aging” can be construed as encompassing age-related medical conditions, which makes the claim a disease claim by proximity. From the FTC angle, “reverses” is an outcome claim that cannot be biologically substantiated on any marketed stem cell protocol.
“Our regenerative protocol reverses the signs of aging and restores youthful vitality.”
“Our protocol is designed to support overall vitality and well-being. Many patients report feeling refreshed and energized after treatment.”
Why: Drop the anti-aging language entirely. Replace with subjective-experience vocabulary that acknowledges patient reports without clinical claims.
Phrase 4: “Guaranteed results”
FTC problem, not an FDA one. Healthcare outcome guarantees are essentially never substantiable because biological variation is always present. Stem cell marketing is especially exposed here because patient investment is high ($5K–$25K) and the outcome varies widely by indication, dose, cell source, and patient history.
A commercial satisfaction guarantee is defensible if phrased as a service-experience commitment, not a clinical-outcome promise.
“Guaranteed pain relief or your money back.”
“We offer a 30-day consultation-fee refund policy if you're not satisfied with your initial experience. Clinical outcomes vary and are discussed in detail during your consultation.”
Why: The commercial refund survives. The clinical outcome promise does not. Don't publish both in the same sentence.
Phrase 5: Unbounded efficacy testimonials
“I was wheelchair-bound, now I run 5 miles a day.” “My pain is completely gone.” “This changed my life.” Published as testimonials on the clinic’s site or social feed without typical-experience disclosure, each one is an FTC Endorsement Guides violation - and a de facto cure claim.
The clinic is responsible for the claim made in a testimonial it publishes. Republishing a patient’s outcome doesn’t transfer the regulatory risk to the patient.
“'Before stem cells, I couldn't walk. Now I run 5 miles a day.' - Real patient”
“'After treatment I found I had more energy and could do more of the activities I enjoy.' - Patient experience, individual results vary, not typical of all patients.”
Why: Solicit patient stories in subjective-experience terms. Include typical-experience disclosure on every featured outcome. Keep substantiation files (the patient's actual outcome data) with the testimonial.
If the testimonial is persuasive only because it says something your own marketing can’t legally say, it’s an enforcement trigger regardless of whether the patient actually said it.
What a compliant regen-med marketing page looks like
The compliant page doesn’t name medical conditions in the marketing copy. It doesn’t use treatment verbs. It doesn’t make guarantees. It describes the procedure, the patient experience, the general wellness goals, and routes anything medical to a consultation.
- Hero:“Regenerative medicine for patients exploring alternatives to conventional care.”
- Procedure description: What happens during treatment, how long it takes, what the experience is like. No disease claims.
- Who it’s for:“A consultation will help determine whether you’re a candidate based on your health history.” Not “suitable for patients with X.”
- Risks: Honest side-effect profile. Boosts trust, covers legal exposure.
- Testimonials: Subjective-experience language, typical-experience disclosure, substantiation file retained.
